The charity, The Minster’s House at Bocking End at 79 Broad Road, Braintree, Essex CM7 9RZ, intends to change the purposes of the charity as stated in the Charity Commission Schemes dated 11 June 1880, 16 August 1979 and 4 November 1983 (the Governing Documents) as:
“The new Minister’s house …shall be henceforth held for the benefit of the Minister of the said Chapel for the time being, in lieu of the messuage comprised in, and upon and for the trusts declared by, the said Indenture of 10 November 1750, so sold as aforesaid in pursuance of the Order of the said Board dated 31 January 1832.” “The Trustees shall apply the clear income …for the purpose of furthering the religious and other charitable purposes of the Congregational Chapel at Bocking End and the congregation meeting for religious worship therein.”
The trustees of the charity propose adding a dissolution provision into the trust and change the ultimate beneficiary, as there is no longer a congregation at Bocking End. The following will be added in the Governing Documents –
‘Dissolution Provision. – The Trustees may dissolve the charity number 2 if they decide that it is necessary or desirable to do so. On dissolution of the Charity number 2, the Trustees have the power to sell any assets of the charity including any properties and to apply any such sale proceeds, subject to the deduction of any costs and liabilities, to be used for the Trustees’ wider charitable purposes, including but not limited to the support of evangelical congregational churches within the wider geographical area of benefit.’
The purposes of the charity will be extended to include an ultimate beneficiary, being the Evangelical Fellowship of Congregational Churches Trust Corporation Limited and will allow the trustees to apply the assets of the charity in furtherance of the support of evangelical congregational churches within the wider geographical area of benefit.
